Article 1: These regulations are formulated in accordance with the Decision on Deepening the Reform of the Party and State Institutions by the Central Committee of the Communist Party of China and the Wenzhou City Institutional Reform Plan approved by the Provincial Party Committee and the Provincial Government. Article 2: The Wenzhou Municipal Comprehensive Administrative Law Enforcement Bureau is a department of the municipal government, operating under the name of the Wenzhou Municipal Urban Management Bureau and is at the county level. Article 3: The Wenzhou Municipal Comprehensive Administrative Law Enforcement Bureau implements the policies and decisions of the Central Committee of the Communist Party, the Provincial Committee, and the Municipal Committee on comprehensive administrative law enforcement and urban management. In fulfilling its duties, the bureau upholds and strengthens the centralized and unified leadership of the Party over comprehensive administrative law enforcement and urban management. The primary responsibilities are: (1) to publicize, implement, and execute the national and provincial/municipal laws, regulations, guidelines, and policies on comprehensive administrative law enforcement and urban management; and to organize the drafting of normative documents and management standards in the field of comprehensive administrative law enforcement and urban management, as well as overseeing their implementation. (2) To develop urban management strategies, medium and long-term development plans, and annual plans, and to organize their implementation. To participate in the formulation of specialized plans for urban appearance and sanitation, municipal utilities, and landscaping with urban and rural planning authorities, and to participate in the review of urban construction project design schemes and preliminary designs. (3) To be responsible for organizing, guiding, coordinating, supervising, inspecting, and comprehensively evaluating the city's comprehensive administrative law enforcement and urban management work. (4) To exercise all or part of the administrative penalties and related administrative supervision and inspection, administrative enforcement powers stipulated in laws, regulations, and rules in the fields of urban appearance and sanitation, urban and rural planning, landscaping, municipal utilities, ecological environment protection, market supervision (unlicensed business operations in outdoor public places), public security (occupying sidewalks, raising animals that disturb others' normal life), land and mineral resources, construction, real estate, civil defense, water administration, production safety, protection of petroleum and natural gas pipelines, education management, etc. The transfer of comprehensive administrative law enforcement powers is based on the approval of the provincial government and is subject to the announcement of the municipal government. (5) To be responsible for major cases, cross-regional cases, and organizing citywide major comprehensive administrative law enforcement activities and special activities. To undertake the handling of administrative penalty cases directly under the jurisdiction of the city, and to directly file and investigate administrative penalty cases of nonfeasance by the comprehensive administrative law enforcement departments of counties (cities, districts). (6) To be responsible for the management of municipal urban appearance and sanitation, municipal utilities, landscaping, and other infrastructure and related administrative permits. To participate in the formulation of annual plans for comprehensive administrative law enforcement and urban management maintenance funds with the finance department, and to organize and supervise their implementation and use. To be responsible for urban water conservation work. To organize and coordinate emergency response work for urban flood control, typhoon resistance, and various sudden incidents in urban management. (7) To be responsible for formulating the overall, short-term, and long-term plans for smart urban management. To be responsible for identifying, collecting, and handling urban management issues; supervising and evaluating the resolution of urban management issues by relevant departments and governments of counties (cities, districts). (8) To complete other tasks assigned by the CPC Wenzhou Municipal Committee and the Municipal People’s Government. (9) Regarding the division of responsibilities: The Wenzhou Municipal Comprehensive Administrative Law Enforcement Bureau and the departments implementing comprehensive enforcement shall clearly define their departmental responsibilities. The departments in charge of business are responsible for strengthening source control and coordination guidance, fulfilling policy formulation, review and approval, post-approval supervision, coordination guidance, and other duties according to law, and strengthening supervision during and after the event. The comprehensive administrative law enforcement department is responsible for investigating, punishing, and subsequent supervision of illegal activities. |
